   (J)   Minimum fees, residential. No permit fee for a construction or remodeling project shall be less than $50. The zoning fee if required, the cost of any required inspection fees as listed above, and the cost of a certificate of occupancy if required, are additional costs. The minimum permit fee does not apply to a fence-only permit or demolition permits.
   (K)   Basement conversions to living space. Reduced fee basements for which permit fees were paid under division (B) of this section are given a special rate for remodeling that converts any existing area of the basement to living space. The special rate is calculated by subtracting the basement rate from the living space rate. Rates used in the calculation are as of the day the remodeling permit is approved. Other applicable fees are at rates stated in the above divisions. The reduced fee is not available for basement additions.
   (L)   Foundation-only permits, residential; optional.
      (1)   A permit for a structure foundation may be issued prior to the application for and approval of permits required under divisions (B) and (C) above. The Town Building Administrator and the Town Engineer shall set guidelines for information required to be submitted. Consideration of this type of permit is restricted as described in § 150.28(D) of this code.
      (2)   The applicant will complete a waiver approved by the Plan Commission Attorney as part of the requirements for the permit.
      (3)   The scope of this permit is limited to footings, foundation walls of which at least 51% will be below grade, and concrete floors at or below grade. Plumbing, electrical, and HVAC work is limited to those specific items needed prior to backfilling and/or pouring concrete floors.
      (4)   This permit expires in 30 days from issuance unless a complete application for a building permit as required in divisions (B) or (C) of this section is filed with the Building Administrator prior to expiration unless the Building Administrator approves for extension prior to expiration. Once the building permit required in this section is approved and released by the Building Department, the applicant shall pick up and pay for the building permit within 30 days of the date of notification by the Building Department.
      (5)   (a)   The fees shall be as given in division (F) above. All necessary inspection fees will be charged per division (G) above.
         (b)   A credit will be issued for the portion of the valid foundation-only permit fee based on square footage to be used only for the subsequent building permit. The credit is limited to the amount of the building permit fee based on square footage under division (B) or (C) above, whichever is applicable, for the same structure as the foundation-only permit. No credit will be given for expired foundation-only permits.
      (6)   If this permit expires, no fees will be credited or refunded, and the applicant must re-apply for a foundation-only permit or make application for a full permit under division (B) or (C) above.

      (1)   Each permit for making an opening shall be confined to a single project, and shall be issued by the executive or other duly designated town representative. Application shall be made on a form proscribed by the Town Council providing the exact location of the proposed opening, the kind or type of paving, turf or fill, the area and depth to be excavated, and such other facts and information as may be required. The town and/or the Town Engineer reserves the right to impose reasonable conditions upon the applicant, as well as the right to deny the application in order to protect town improvements or upon a finding that a less intrusive method exists.
      (2)   No permit shall be issued until or unless the applicant tenders and pays the fee required in conformance with the schedule contained hereinafter. The permit fee is in an amount reasonably calculated to cover at least a portion of the cost of restoration and maintenance of the opening, as well as all other related administrative expenses thereto.
      (3)   All such fees collected for the purposes stated herein shall be deposited in the town’s General Fund for use consistent with the requirements of this chapter, as amended hereafter from time to time.
      (4)   The opening, restoration and maintenance of a pavement or other surface shall be performed under the direction and to the satisfaction of the Town Engineer, or other duly designated town representative, and in accordance with rules, regulations, and specifications approved by the Town Council.
      (5)   In the event of the failure and/or refusal of the permittee to satisfactorily fill the excavation, restore the surface and remove all excess materials in accordance with the terms of the permit, and within the time specified in the permit, or where such time period is not specified in the permit within a reasonable time, the town may proceed to make such fill and restoration. In the event the amount of the costs incurred by the town exceed the amount of the restoration services performed by it, the town shall be entitled and permitted to collect any excess amount due and owing from the permittee, including attorney’s fees, court costs, and similar related expenses of collection.
