§ 74.10 PROHIBITED COMMERCIAL VEHICLE/TRUCK PARKING IN COMMERCIAL, PLANNED DEVELOPMENT COMMERCIAL AND PLANNED DEVELOPMENT MIXED ZONING DISTRICTS.
   (A)   Overnight parking prohibited. It shall be a violation of this section for the owner, operator or driver of any commercial vehicle/truck with more than two axles, or for the person in charge thereof, to park such commercial vehicle/truck or to permit it to be parked or to stand upon any street or alley or property in a commercial, planned development commercial, or planned development mixed zoning district within the town between the consecutive hours of 12:00 a.m. midnight and 6:00 a.m., for a period longer than one hour, if the commercial vehicle/truck is not specifically licensed and registered to the owner of record of the real property where the commercial vehicle/truck is located. Commercial, planned development commercial, and planned development mixed zoning districts where commercial vehicle/truck parking shall be prohibited by this section shall be those districts identified as commercial zoning districts, and specifically, C-l Neighborhood Commercial Zoning District, C-2 Office Commercial Zoning District, and C-3 General Commercial Zoning District, PDC Planned Development Commercial Zoning District, and PDM Planned Development Mixed Zoning District, all as defined and set forth in the town's Zoning Code.
   (B)   Commercial vehicle(s)/truck(s) defined. For purposes of this section, a COMMERCIAL VEHICLE/TRUCK shall not include town or other government vehicles, public utility vehicles, vehicles delivering services or materials to any commercial business, entity, or establishment where the commercial vehicle/truck is parked, or authorized emergency vehicles. Commercial vehicles/trucks shall include every transport vehicle designed, maintained, or used primarily for the transportation of property. A commercial vehicle/truck shall, in addition to the tractor portion of said commercial vehicle/truck, include disconnected trailers, flatbeds, or the like, which may have been disconnected or otherwise separated from a commercial vehicle/truck tractor and left in a commercial, planned development commercial or planned development mixed zoning district within the town.
   (C)   Penalty. Any owner, operator, or driver of any commercial vehicle/truck, in violation of this section shall be subject to the penalty provisions of § 74.87, as amended from time to time. Each occurrence shall constitute a separate violation.
