349.12 SQUEALING TIRES, CRACKING EXHAUST NOISES; OPERATING A MOTOR VEHICLE WITH AN UNMUFFLED OR IMPROPERLY MUFFLED ENGINE BRAKE; PENALTY.
   (a)   No person shall operate any motor vehicle, except when necessary for safe operation or in compliance with the law, in such a manner as to cause the engine or exhaust system to emit a loud, cracking or chattering noise unusual to its normal operation, or in such a manner as to cause the tires of such vehicle to squeal or leave tire marks.
   (b)   No person shall operate a motor vehicle in the City which is equipped with an engine brake, a compression brake, or similar exhaust braking system unless the motor vehicle is equipped with the proper muffler or mufflers. For purposes of this section, a proper muffler shall mean a functioning factory installed muffler or an equivalent after-market muffler or a muffler that meets all state and federal rules, regulations and standards. The emission of a loud staccato noise from any such motor vehicle shall be a prima facie evidence that the motor vehicle is being operated without the proper muffler or mufflers.
   (c)   The requirements stated above do not pertain to Police, Fire, Military or Emergency Service Vehicles.
   (d)   Whoever violates any provisions of this section shall be fined not more than five hundred dollars ($500.00).
