1701.04 VIOLATIONS, PENALTIES AND INJUNCTIVE RELIEF.
   (a)    Unlawful Acts. It shall be unlawful for any person, firm, corporation, or legal entity to erect, construct, alter, extend, repair, remove, demolish, maintain, fail to maintain, provide, fail to provide, occupy, let to another to occupy or permit another person to occupy any premises, property, structure, or equipment regulated by the Town of Winfield Building Code, or cause same to be done, contrary to or in conflict with or in violation of any of the provisions of the code, or fail to obey a lawful order of the code official, or to remove or deface a placard or notice under the provisions of the code.
   (b)    Penalties. Any person, firm, corporation or legal entity who shall violate a provision of the Town of Winfield Building Code, upon conviction thereof shall be fined not more than $500.00 for a first offense, or incarcerated for a period not to exceed thirty (30) days, or both; and $1,000 for a second or subsequent offense, or incarcerated for a period not to exceed thirty (30) days, or both. Each day that a violation continues after due notice has been served shall be deemed a separate, offense. Fine, imprisonment, or both, together with Court costs shall be imposed by the Municipal Judge of the Town of Winfield upon conviction of violation of the Code.
   (c)    Injunctive Relief. In the case of any unlawful acts, the Mayor, or such person as the Mayor may designate, is hereby authorized and empowered to institute and maintain a suit to restrain by injunction the violation of Building Code notwithstanding the penalty for the violation thereof.
