155.05  HOLIDAYS; HOLIDAY PAY.
   (a)   The following days are recognized as holidays for the employees of the Village of Windham: The first day of January (New Year’s Day), the third Monday in January (Martin Luther King Day), the last Monday in May (Memorial day), the fourth of July (Independence Day), the first Monday in September (Labor Day), the second Monday in October (Columbus Day), the fourth Thursday in November (Thanksgiving), the fourth Friday in November, the twenty-fourth day of December (Christmas Eve), and the twenty-fifth day of December (Christmas).  (Ord. 2009-40.  Passed 1-26-10.)
      (1)   After one year, in addition to the above listed holidays, each full-time employee shall be entitled to two (2) floating holidays to be used at the employee’s discretion subject to approval by his department head with at least 72 hours notice.
      (2)   All floating holidays must be taken between January 1st and December 31st of the calendar year in which they are recognized and cannot be carried over from year to year.  The floating holidays shall be in effect beginning January 1, 2009.

   (b)    All full-time salaried employees and full-time hourly employees of the Village shall be entitled to holiday pay in lieu of time away from employment in an amount equal to eight (8) hours pay for each such holiday unless they work a regularly scheduled shift in excess of eight (8) hours in which case they shall be paid for that number of hours.  This holiday pay will be paid to all qualified employees, and will be paid in addition to any pay earned for working on the holiday.

   (c)   All hourly full time employees of the Village of Windham who work a legal holiday as set forth in subsection (a) hereof shall be paid at one and one-half times their base rate of pay effective July 2, 1989.  (Ord. 1324.  Passed 6-13-89.)
   (d)    Holiday pay will be paid with the next regular pay due the employee following the holiday.  (Ord. 791. Passed 2-7-66.)
   (e)   The holiday and holiday pay schedule as is set forth in subsections (a), (b) and (c) of this section shall not apply to full time police department employees.  For purposes of this section a full time employee of the Village of Windham Police Department is an employee who is regularly scheduled forty (40) hours in each non-vacation week.  Full time employees of the Village of Windham Police Department are hereby granted a total of ninety-six (96) hours of holiday time.  The ninety-six (96) hours of holiday time may be used in a minimum of four (4) hour increments and, subject to seventy-two (72) hour advance approval of the employee’s supervisor, may be used at a time of the employees selection.  Each employee is limited to using forty-eight (48) of these floating holiday hours within the first (6) months of a calendar year and then may use the remaining forty-eight (48) hours of this floating holiday in the second six (6) months of a calendar year.  The use of these holiday hours is as set forth in this section is mandatory for full-time employees for the Village of Windham Police Department.  During the calendar year 2012 the number of holidays available for use by the full-time employees of the Village Police Department shall be pro-rated based on the number of paid holidays already received by the full-time employees as of the date this code section was enacted.

   (f)   All part time Village of Windham Police Department employees shall receive the following benefits:
      (1)   If the employee works on any of the holidays identified in Section 155.05(a) a part-time Police Department employee shall be paid at the rate of one and one-half (1-1/2) times the employee’s regular rate of pay.
      (2)   No compensation time is available for part-time Police Department employees.
      (3)   No sick time benefit is available for part-time Police Department employees.
      (4)   No other benefits shall be paid to part-time employees of the Village Police Department.
      (5)   Application of the benefits to part-time Police Department employees as is established in this Section 155.05(f) shall apply prospectively only.  Village of Windham part-time Police Department employees shall not lose or forfeit any benefit which have accrued under prior legislation or departmental policy prior to the enactment of this section.
