139.01  UNIFORM REGULATIONS.
   (a)   Police Chief and Patrolmen.
      (1)   All Police Department Patrolmen shall wear uniforms approved by the Police and Fire Committee Council.  The Police Chief’s Uniform shall include white shirts or dark blue and dark blue pants.  Patrolmen’s uniforms shall include dark blue shirts and dark blue pants.  Proper dark blue uniforms are referred to in this section of the code as “BDU”.  BDU’s shall only be used during the afternoon or midnight shift or when working special details.
      (2)   Police Chief, Patrolmen and Dispatch uniforms sets shall be as follows:

Any Field Equipment the Police Chief deems acceptable for officers and dispatchers to perform necessary duties, including but not limited to the following: BDUs, Basic Duty Uniform, Key Holder, Duty Belt, Holster, Socks, Whistles, Name Tag, Reflective Vests, Magazine Holders, Belt Keepers, Batons.
      (3)   New patrolmen in the Department will be supplied with the appropriate season set, and after six months service the uniform set will be completed.
      (4)   Uniform adjustments that might be required because of change in Department status will be considered individually by the Safety Committee of the Village Council.
   (b)   Clerks.  Each full-time employed clerk shall receive three (3) uniforms to start.  Uniforms include: three (3) uniform shirts with patch insignia on left side and name on the right side embroidered on shirt.  The color of shirt shall be white or dark blue.  Three (3) navy blue pants the color.  Before any new full-time clerk shall receive issuance of uniforms, the clerk must be employed for ninety days.  A clerk must remain in the employ of the Village of Windham for six months or upon leaving the employee shall reimburse the Village for the cost of the clerk uniform provided.
   (c)   The annual clothing allowance for the full-time police officer shall be on a reimbursement basis, pursuant to the police officer submitting a receipt for the item purchased and receiving reimbursement through a purchase order established for that purpose, up to four hundred fifty dollars ($450.00).
   (d)   The annual clothing allowance for the full-time dispatcher (clerk) shall be on a reimbursement basis, pursuant to the full time dispatcher (clerk) submitting a receipt for the item purchased and receiving reimbursement through the purchase order established for that purpose, up to two hundred seventy-five dollars ($275.00).
   (e)   The annual clothing allowance for the part-time patrolman shall be on a reimbursement basis, pursuant to the part-time patrolman submitting a receipt for the item purchased and receiving reimbursement through the purchase order established for that purpose, up to one hundred fifty dollars ($150.00).  The part-time patrol uniform will be same as a full-time patrolman.
   (f)   The annual clothing allowance for the part-time dispatcher (clerk) shall be on a reimbursement basis, pursuant to the part time dispatcher (clerk) submitting a receipt for the item purchased and receiving reimbursement through the purchase order established for that purpose, up to seventy-five dollars ($75.00).  Part-time dispatchers shall wear the same uniform as a full- time dispatcher.  (Ord. 2009-44.  Passed 2-23-10.)
   (g)   In addition to all the uniform requirements set forth in this Section 139.01, each officer is required to have and wear on duty a bullet proof vest.  In the event an officer elects not to provide his own bullet proof vest the Village will supply a vest upon the following terms:
      (1)   In the year that the Village supplies an officer with a bullet proof vest $150.00 of the clothing allowance established for the officer through the other subsections of this Codified Ordinance Section shall be applied toward the purchase of the bullet proof vest.
      (2)   In each of the next subsequent four years, one quarter of the purchase price of the bullet proof vest shall be deemed paid for by the officer.  This deduction of one quarter of the purchase price of the bullet proof vest shall not be applied to or used against the officer’s clothing allowance for that year.  After full five years the bullet proof vest acquired through the Village will be owned outright by the officer, and the officer shall have no further obligation to the Village with respect to the vest.
      (3)   In the event an officer leaves employment as a police officer with the Village before the total cost of the bullet proof vest has been paid to the Village under the arrangements set forth in subsection (2) of this section, the outstanding amount owed to the Village shall be deducted from the final pay to the officer.
      (4)   If the Village receives grant funds to assist in the acquisition of bullet proof vests the Chief of Police is authorized to vary from the provisions set forth in this section, but only to the extent it is necessary to comply with the applicable terms of the grant.  (Ord. 2014-11.  Passed 5-29-14.)
