§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person violating any provision of § 90.02 shall be deemed to have committed an ordinance violation and, upon conviction, shall be fined not less than $25 and not more than $100, in addition to court costs.
      (2)   If any person charged with a violation of any provision of § 90.02 pays the sum of $15 to the Clerk/Treasurer within 72 hours after receiving written notice of the charge by the Police Department, no further proceedings shall be commenced or continued against that person due to that violation of § 90.02.

   (C)   Any person who maintains a public nuisance, as described in § 90.03, or who permits a public nuisance to be maintained on any property under the control of that person shall be deemed to have committed an ordinance violation and, upon conviction, shall be fined not less than $25 nor more than $200, in addition to court costs. Each day a public nuisance is established or maintained constitutes a separate ordinance violation.

   (D)   In addition to any costs imposed under §§ 90.01, and 90.04 through 90.08, any person, corporation, partnership, sole proprietorship, or owner, occupant, or tenant of real estate who is found to have violated §§ 90.01, and 90.04 through 90.08, or willfully or negligently failed to comply with any provision of §§ 90.01, and 90.04 through 90.08, or with any orders issued hereunder, shall be fined not less than $100, nor more than $1,000 for each offense. Each day a violation shall occur or continue shall be deemed a separate and distinct offense. Citations for violations of §§ 90.01, and 90.04 through 90.08 may be issued by the enforcement authority or by the Town Marshal, or one of his or her deputies. The uniform traffic citation may be utilized for the purpose of evidencing violation of §§ 90.01, and 90.04 through 90.08. Enforcement shall be in effect by the filing of a civil suit seeking judgment in the amount of the fine imposed, plus court costs.
   (E)   Any person who violates any provision of § 90.36 shall be deemed to have committed an ordinance violation and, upon conviction, shall be fined not less than $25 nor more than $200, in addition to court costs. Each day a violation continues constitutes a separate ordinance violation.
