§ 70.99 PENALTY.
   (A)   Any person, firm, or corporation who violates any provision of this chapter for which another penalty is not specifically provided, shall, upon conviction, be subject to a fine not exceeding $2,500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues (I.C. 36-l-3-8(a) 10).
   (B)   Any person issued a citation as described in § 70.02 shall pay a civil penalty of a minimum of $25, up to a maximum of $1000 for each citation. Any such penalty shall be payable to the Ordinance Violations Bureau.
   (C)   (1)   The Winchester Police Department shall issue a citation to any person the officer has probable cause to believe has violated of the Indiana Traffic Code, city traffic ordinances, or § 70.03 while operating a golf cart whether the offending person is a juvenile or other person.
      (2)   The Police Department shall, upon the discovery of the violation of the licensing provision of § 70.03, immediately take custody of the vehicle and have same towed to an impoundment lot. In the event of this violation, in addition to the penalties set forth below, the operator/owner shall be responsible for the payment of all costs of towing and storage of the vehicle. The fines for violation of § 70.03 shall be the following:
         (a)   First offense - $50.
         (b)   Second offense within one year - $100.
         (c)   Third offense within one year - $500.
      (3)   A fine assessed for a violation of a traffic ordinance associated with § 70.03 will be deposited in the city's General Fund.
      (4)   Permitting a violation.
         (a)   No person shall knowingly allow a violation of § 70.03 by allowing an unlicensed person to use, borrow, lease or rent a golf cart to be operated within the city.
         (b)   The penalty for allowing a violation will be equal to the cost of the initial violation:
            1.   First offense - $50.
            2.   Second offense within one year - $100.
            3.   Third offense within one year - $500.
