8-11-2: DEFINITIONS:
AUTOMATED TRAFFIC LAW ENFORCEMENT SYSTEM: The device within the Village of Willowbrook with one or more motor vehicle sensors working in conjunction with a red light signal to produce recorded images of motor vehicles in an intersection against the steady or flashing red signal indication in violation of section 11-306 of the Illinois Vehicle Code 1 (the "Code"), or similar violation of this Code. Automated traffic law enforcement system is designed to produce recorded images of a motor vehicle's violation of the Code or this Code to obtain a clear recorded image of the vehicle and the vehicle's license plate.
COMPLIANCE VIOLATION: A violation of chapter 7 of this title.
DISREGARDING A TRAFFIC CONTROL DEVICE: The failure to stop and remain stopped before an intersection that is controlled by a red signal as provided for in section 11-306 of the Illinois Vehicle Code.
HEARING OFFICER: An attorney, in good standing, licensed to practice law in the State of Illinois for at least three (3) years proceeding his/her appointment.
NO TURN ON RED: The failure to stop and remain stopped, and not proceeding to turn right at an intersection controlled by both a sign indicating "No Turn On Red", or other similar language, and a red signal as provided for in section 11-306 of the Illinois Vehicle Code.
RECORDED IMAGES: The images produced by the automated traffic law enforcement system, which consist of either: two (2) or more photographs; two (2) or more microphotographs; two (2) or more electronic images; or a video recording showing the motor vehicle and, on at least one image or portion of the recording, clearly identifying the registration plate number of the motor vehicle. Recorded images made by an automatic traffic law enforcement system are confidential and shall be made available only to the alleged violator and the Village for the purposes of adjudicating a violation of this chapter, for statistical purposes, or for other governmental purposes. Any recorded image evidencing a violation of this chapter, however, may be admissible in any proceeding resulting from the issuance of the citation. The recorded image shall display the time, date, and location of the violation.
TRAFFIC COMPLIANCE ADMINISTRATOR: The person appointed as such pursuant to section 11-208.6 of the Illinois Vehicle Code and shall have the following additional powers: adopt, distribute and process automated traffic law violation notices and other notices required by this chapter, collect money paid as fines and penalties, operate the automated traffic law enforcement system, and make certified reports to the Secretary of State as required by law.
