12-1-3: EXCLUSIVE REMEDY:
The procedure hereinafter set forth for the processing of grievances shall constitute the sole and exclusive remedy or recourse for the expression and settlement of employment related grievances. Any failure to follow the procedure as set forth herein, or the organization or participation in a strike, slow down, picketing, or other job action shall subject the employee to disciplinary action in accordance with applicable State law, rules and regulations set forth in the procedures (employment) manual or in any published rules and regulations governing the conduct of members of any particular department or agency of the Village. Any disciplinary action shall be in accordance with the procedures set forth in chapter 2 of this title.
Notwithstanding any provision contained herein to the contrary, any police officer, other than the Chief of Police, holding a sworn rank may only be dismissed, discharged or suspended in accordance with the rules and regulations promulgated by the Board of Police Commissioners pursuant to the authority contained in 65 Illinois Compiled Statutes 5/10-2.1-1 et seq. The Chief of Police may be removed or discharged in accordance with section 2-4-8 of this Code. (Ord. 02-O-01, 2-11-2002)
