337.31 EXHAUST SYSTEM, TRUCK WEIGHING IN EXCESS OF 8,000 POUNDS.
   (a)   A truck with a gross vehicular weight in excess of 8,000 pounds is prohibited within the City from racing the motor in such a manner that the exhaust system emits a loud, cracking or chattering noise unusual to its normal operation, and which is referred to as engine braking.
 
   (b)   A truck with a gross vehicular weight in excess of 8,000 pounds is prohibited within the City from using an engine retarder. For the purpose of this section, an “engine retarder” is defined as any type of engine retarder commonly used as an engine braking system within the trucking industry, including but not limited to C Brakes, Pac Brakes, Tek Brakes and Jake Brakes. This restriction shall not apply to emergency vehicles.
 
   (c)   Whoever violates this section is guilty of a minor misdemeanor.
