(a) No new building or structure shall be occupied or used, in whole or in part, and no change in the use of an existing building or structure, or any part thereof, shall be permitted, until a Final Certificate of Occupancy shall have been issued by the City Building and Zoning Inspector.
(b) Final Certificate of Occupancy is written certification by the Building Official that all the requirements of the building codes and Ordinances of the City for construction of a new house, accessory building, or addition thereto, or renovations to an existing building requiring major restructuring of a building, have been completed satisfactorily and the structure is safe to occupy and use, subject to Section 1331.07
(b).
(c) Conditional Occupancy Permit may be issued at the discretion of the building Official. It is a written notice allowing occupancy in situations where there are minor, non-safety items yet to be completed. The Conditional Occupancy permit must stipulate the conditions under which the structure may be occupied listing the specific items to be completed and state a time limit for completion, not to exceed ninety (90) days, except in the case of final grading and seeding, which can be given a time limit not to exceed six (6) months. Failure to complete the items noted within the stated time limit will result in nullification of the conditional occupancy and further occupancy or use of the structure is subject to prohibition in Section 1331.07
of this Chapter. This subsection is subject to subsection (d).
(d) No Conditional Occupancy Permit mentioned in this section shall be issued unless all applicable fees and deposits have been paid.
