921.08 ASSESSMENT CHARGES FOR CONNECTION TO THE SANITARY SEWER CONSTRUCTED AS PART OF THE SAYLE FARM SUBDIVISION NO. 3.
   (a)   The Director of Finance is hereby authorized and directed to collect a fee of three thousand five hundred and sixty-seven dollars ($3,567.00) per acre for all lands not yet connected whose sanitary sewage is transported to the treatment plant of the City of Euclid via the sanitary sewer facilities constructed as part of the Sayle Farm Subdivision III development. A portion of these charges is pursuant to an Agreement executed February 18, 1987 between the City of Willoughby Hills, Ohio and the Willoughby Hills Development corporation. Another portion of these charges is attributed to improvements made to the Istra Pump Station by the City of Willoughby Hills. Said improvements upgraded the capacity of the Istra Pump Station to permit additional connections to the sewer system. Said charge shall be in addition to any other tap-in charges imposed by law.
   (b)   Certified copies of the legal description of the assessment area are on file in the Office of the Clerk of Council and the Director of Finance, and said legal descriptions are incorporated by reference into this section of this ordinance as if fully rewritten herein.
   (c)   The Director of Finance is hereby authorized and directed to remit a portion of the funds collected under the authority of this section to the Willoughby Hills Development Corporation until such time that all properties within said assessment area have been connected to the sanitary sewer system. The portion of each assessment to be remitted to the Willoughby Hills Development Corporation shall be three thousand one hundred and twenty-three dollars ($3,123.00) per acre. The balance of each assessment, four hundred and forty-four dollars ($444.00) per acre, is payable to the City of Willoughby Hills.
