509.10 MINOR'S CURFEW.
   (a)   Curfew Hours and Restrictions.
(1)   No child under the age of thirteen years shall be upon the streets, sidewalks, beaches, recreational areas, parking lots, public or private playgrounds, public or private school grounds, or any other public. or private place of assembly between darkness and dawn.
(2)   No child age thirteen through fifteen shall be upon the streets, sidewalks, beaches, recreational areas, parking lots, public or private playgrounds, public or private school grounds, or any other public or private place of assembly between the hours of 11:00 p.m. and 6:00 a.m.
(3)   No child age sixteen or seventeen shall be upon the streets, roadways, sidewalks, beaches, recreational areas, parking lots, public or private school grounds or any other public or private place of assembly between the hours of 12:00 midnight and 5:00 a.m.
   (b)   Parent or Guardian Responsibility. No parent or guardian shall allow any child between the ages and hours applicable to such child, as set forth in subsection (a) hereof, to be upon any street, roadway, highway, sidewalk, park, beaches, parking lots, public or private school grounds, church grounds, or any other public or private place of assembly.
   (c)    Curfew not Applicable.
(1)   This curfew shall not apply to minors on an emergency errand as directed by the parent, guardian, custodian or responsible person over the age of twenty-one years, or a member of the minor's family over eighteen years of age who has been given legal responsibility for the minor's care, control, and custody.
(2)   This curfew shall not apply to minors returning from any school, church, lodge or other similar civic, school, or religious organization sponsoring a function that minors may attend. However, if minors are not within the confines of their homes within one hour after such function has ended, the provisions of this curfew shall be applicable and in full force and effect.
(3)   This curfew shall not apply to minors who are returning directly home from their place of lawful employment.
(4)   This curfew shall not apply to any minor that is accompanied by his parent, guardian or other responsible person over the age of twenty-one years, or a member of the minor's family over eighteen years of age who has been given legal responsibility for the minor's care; control, and custody.
   (d)   Penalty. Whoever violates this section is guilty of curfew violation, a minor misdemeanor offense. If the offense results in physical harm to any person and/or property, or if the offender has been previously convicted of curfew violation, a violation of this section shall be a misdemeanor of the fourth degree.
