1183.09 PERMIT REQUIRED FOR OTHER PUBLIC ART ON PRIVATE PROPERTY.
   Any person, firm, corporation or association desiring to place artwork in a public place on private property, other than required public art, shall first obtain a public art permit from the Building Department according to the following.
   (a)   Applications for a public art permit issued under this Section shall include payment of the application fee and the following information:
      (1)   Name and address of the owner, operator, or the person in possession of the premises where the artwork is to be located.
      (2)   Name and address of the creator of the artwork.
      (3)   Preliminary sketches, photographs, or other documentation of sufficient descriptive clarity to establish the nature and location of the proposed artwork, and to adequately evaluate the artwork's compatibility with the character of adjacent development and existing neighborhood.
      (4)   Drawings showing the dimensions, construction supports, sizes, foundation, electrical wiring and components, materials of the artwork and method of attachment and character of structure members to which attachment is to be made. The design, quality, materials and loading shall conform to the requirements of the City's Building Code.
   (b)   Upon receipt of a completed application, the PAC shall conduct a review within thirty (30) days.
      (1)   The artist or organization sponsoring the artwork shall be available for an interview.
      (2)   The PAC shall review the application and plans based upon the criteria for public art, and submit a recommendation to the Planning Commission, and Design Review Board when applicable.
   (c)   The Planning Commission's approval of an application is granted for the specific design and onetime production of the artwork presented. Any changes thereafter must be submitted to the PAC and Planning Commission for further review.
   (d)   This permit is revocable by the City if it is determined at any time that the artwork being installed does not comply with the information provided with the application and its approval.
   (e)   Unless a shorter period of time has been established by official action, this permit expires 180 days from issuance if the work permitted hereunder has not been commenced and one (1) year after issuance if the installation of the approved artwork has not been completed. This permit shall also expire if it is determined the work authorized by the permit has been suspended, discontinued or abandoned for a continuous period of 180 days.
   (f)   An applicant who has been denied a permit under this section may appeal to the Board of Appeals.
