432.42 USE OF ENGINE OR TRANSMISSION BRAKING DEVICES.
   (a)   No person may slow a vehicle by a device, method, or practice known as engine braking or transmission braking, also referred to as “jake braking” or “dynamic braking”, whereby rapid downshifting of a vehicle’s engine or a compression release device is used in lieu of applying a vehicle’s wheel brakes, causing loud noises to emit from the vehicles’ engine and exhaust system on any public highway, street, parking lot, or alley within the City. This provision does not apply to emergency vehicles.
   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; a misdemeanor of the fourth degree on a second offense within one year after the first offense, and a misdemeanor of the third degree on each subsequent offense within one year after the first offense.
