1399.01 PENALTY PROVISIONS.
   (a)   A violation of any provision of Part Thirteen, the Building Code of the Codified Ordinances of the City, or failure to comply with any order issued pursuant thereto for which no penalty is otherwise provided, shall be a misdemeanor of the first degree and punishable as follows:
(1)   For a first offense, a fine of not less than one hundred dollars ($100.00);
(2)   For a second offense, a fine of not less than five hundred dollars ($500.00) and imprisonment of not more than six months;
(3)   For a third or subsequent offense, a fine of not less than one thousand dollars ($1,000) and imprisonment of not more than six months.
   Each violation shall constitute a separate and distinct violation. Each day’s failure to comply with any provision herein shall constitute a separate violation.
   (b)   The imposition of any penalty shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, or to restrain, correct or abate a violation, or to prevent the occupancy of a building, structure or premises, or to prevent an illegal act, conduct, or use in and about any premises, or to require compliance with the provisions of this Code or other applicable laws, ordinances, rules or regulations, or the orders or determinations of the Property Maintenance Officer or the Zoning Board of Appeals.

   (c)   Where work for which a permit is required is started prior to obtaining such permit, the fees required by such permit shall be doubled; but the payment of such double fee shall not relieve any person from fully complying with the lawful requirements of any Ohio Statute or City Ordinance.
