521.13 REGULATION OF FLYASH LANDFILLS.
   (a)   In addition to the requirements of any other section of these Codified Ordinances or of State statutes regulating landfills other than sanitary landfills, the following regulations shall apply to the type of landfill known as the flyash or cinder landfill:
(1)   The pH factor of the flyash or cinder used in the landfill shall be within limits that meet with the approval of the Ohio Environmental Protection Agency.
(2)   Engineering plans must be prepared and submitted to the City Engineer by an engineer qualified as a soils expert.
(3)   Plans shall include special provisions for the containment of the fill to prevent erosion or bank slope slippage. Such provisions shall include earthen dikes or concrete retaining walls of sufficient design to prevent the movement of the flyash after the fill is constructed. Details of such containment structures shall be determined by the engineer preparing the plans and shall take into account the particular conditions to be encountered for the specific project.
(4)   Plans shall include provisions for the management of storm water runoff and for the relief of any ground water that may affect the stability of the fill.
(5)   Plans shall describe in detail the method of fill construction and shall describe how to handle environmental problems of water runoff and of dust control during construction.
(6)   Plans shall provide for and describe final landscaping and seeding.
(7)   The plans, if approved by the City Engineer, shall then be submitted to the Environmental Review Board, along with an Environmental Assessment Statement to be prepared by the applicant, for customary processing. Upon the final review and recommendation of such Board final action shall be in accordance with the provisions of Chapter 1345.
   (b)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor on a first offense; for a second or subsequent such offense, such person is guilty of a misdemeanor of the fourth degree.
