(A) A SOBP issued under these regulations is not transferable, assignable, or divisible and it is a violation of these regulations for any person to attempt to do so.
(B) Upon transfer by bequest or operation of law upon the death of the enterprise, the SOBP will continue in effect for 45 days after the death of the enterprise.
(C) Upon filing of a new application and posting the application with the prior SOBP, the enterprise may continue to operate until the final determination on the new SOBP.
(D) If no application is filed within the 45 days, the enterprise shall be in violation of these regulations each and every day it continues to operate without a new SOBP.
