(A) (1) The City Council hereby designates and directs the City Manager, or his or her duly authorized agents, to investigate, deny, issue, attach conditions, suspend, and revoke sexually-oriented business permits (SOBPs) pursuant to the above authority and these regulations.
(2) The City Manager shall exercise the power of City Manager, as provided in this chapter.
(B) Pursuant to Tex. Loc. Gov't Code, § 243.007(c), the District Court has jurisdiction over a suit which arises from the denial, suspension, or revocation of a SOBP by the city.
(C) A violation of these regulations is a Class A misdemeanor.
(D) The revocation or suspension of a SOBP shall not prohibit the imposition of a criminal penalty, and the imposition of a criminal penalty shall not prevent the revocation or suspension of a SOBP pursuant to these regulations.
