(A) Persons making discharges of industrial waste shall pay a charge to cover the cost of collection and treatment. In addition, dischargers of industrial waste shall pay a charge to recover the costs of the treatment works capacity allocated to their wastewater. The charge shall be based on wastewater flow and strength and the percentage of useful life of the treatment works remaining at the time of connection to the system. The Industrial Cost Recovery System shall meet the requirements set forth in Title 40, Part 35, of the Federal Register, Monday, 2-11-1974.
(B) When discharges of industrial waste are approved by the approving authority, the city or its authorized representative shall enter into an agreement or arrangement providing:
(1) Terms of acceptance by the city; and
(2) Payment by the person making the discharge.
