§ 53.169 CONFIDENTIALITY/TRADE SECRETS.
   Any information submitted to the city by an industrial user may be claimed as confidential by the submitter. Any such claim must be asserted at the time of submission, by stamping the words “confidential business information” on each page containing such information. The industrial user must demonstrate to the satisfaction of the city that the release of such information would divulge information, processes or methods of production entitled to protection as trade secrets under applicable state law. If no claim is made at the time of submission, the city may make the information available to the public without further notice. If a claim is asserted, the information will be treated in accordance with the procedures in 40 CFR Part 2 (Public Information), but shall be made available immediately upon request to governmental agencies for uses related to the NPDES program or pretreatment program, and enforcement proceeding involving the person furnishing the report. Effluent data (wastewater constituents characteristics) as defined by 40 CFR 2.302 will not be considered confidential under any circumstances and shall be available to the public without restrictions.
