§ 91.09 TOWING CHARGES; STORAGE.
   (A)   The permit holder owner is hereby authorized to collect as a maximum fee from the motor vehicle owner the following:
      (1)   Towing in response to general dispatch of any permitted tow truck: $150.
      (2)   Towing in response to dispatch of heavy-duty tow truck:
         (a)   No damage or abandoned vehicle with no cargo, or weight to be loaded is 15,000 pounds or less: $400.
         (b)   Accident scene with damage and weight to be loaded is 15,000 pounds or less: $450.
         (c)   Where weight to be loaded is more than 15,000 pounds, calculate as cents per pound using following rates:
            1.   Contained cargo, including winching: 3.5.
            2.   Total loss recovery: 5.0.
            3.   Rollover: 4.0.
            4.   Embankment or incline: 4.5.
         (d)   Recovery and/or salvage of cargo, and mitigation or remediation of hazardous materials such as fuel spills are not regulated by this chapter and are separate costs to be negotiated between owner and whoever is providing that service.
         (e)   For storing a vehicle in an enclosed and locked area each, or any part of, a day: $20.
         (f)   Trailers - boat, utility (single axle): $20.
         (g)   Reloading contents of truck or trailer, per man hour (excludes heavy-duty tow trucks): $35.
   (B)   All storage areas operated and maintained by the vehicle storage facility (VSF) license holder shall charge a daily storage fee that complies with the Administrative Rules of the Texas Department of Licensing and Regulation as found in Tex. Admin. Code, Title 16, § 85.722, as amended.
