The purpose of this chapter is to fairly allocate non-consent tows among the towing service providers when a vehicle’s owner or driver has no preference, or cannot communicate a preference. There are rare occasions, though, where an officer may need to utilize a “first wrecker” call. It may be due to a life safety issue, such as when EMS personnel on the scene need a vehicle lifted off of a person. It may also be because a scene is unstable and any further delay would be detrimental to peace and order. In addition, it may be necessary because the assigned tow truck did not arrive within the required time, or is unable to effect the tow, and to wait any longer is unreasonable given the conditions on scene, call volume, etc. However, a “first wrecker” call is not to be used merely for an officer’s convenience or lack of patience.
