§ 50.01 GARBAGE AND TRASH PICKUP RATES.
   (A)   Exclusive solid waste collection by Waste Management of Texas. Pursuant to applicable law and the WM contract dated December 14, 2021, Waste Management of Texas is the exclusive provider of residential, commercial and industrial solid waste collection within the city. All residents, commercial businesses and industrial businesses within the city shall exclusively use the solid waste collection services provided by Waste Management of Texas.
   (B)   Collection rates. The city hereby adopts the “Base Rate Tables” referenced in Schedule A of the Waste Management of Texas letter dated December 6, 2022, and which is listed below. The Base Rate Table for residential, commercial and roll of collections may be amended from time to time consistent with the Consumer Price Index (CPI) increases as authorized in the WM contract.

   (C)   Administrative franchise fee. The city shall continue to charge an administrative franchise fee of 10% of the monthly garbage and trash collection charges by Waste Management of Texas to cover the city’s administrative costs incurred in billing and collecting these charges.
   (D)   Time and place of payment. All customer accounts for garbage and trash pickup service shall be billed on a monthly basis. Payments shall be due and payable within 15 days after the bill is mailed. Payment shall be made at the City Hall or by mail at 200 N. Bell, Willis, Texas 77378. It shall be prima facia evidence that a billing has been received by a customer if the bill has been deposited in the U.S. Mail, postage paid.
   (E)   Penalties for late payment. There shall be added to each account for garbage and trash services which are not paid as provided in divisions (B) and (C) above, a sum equal to 10% of the amount of said account, as penalty for late payment more than 15 days past the due date.
   (F)   Discontinuance of service. Garbage and trash service to any customer whose account is more than 20 days delinquent shall be cut-off, and the charge therefore will be $25 for resumption of service. The city may also seek civil relief from a court of competent jurisdiction to enforce this section.
