§ 116.15 LICENSE REQUIRED; APPLICATION.
   (A)   Raffle licenses shall be issued only to bona fide religious, charitable, labor, fraternal, educational, veterans', or other bona fide not-for-profit organizations that operate without profit to their members and which have been in existence continuously for a period of five years immediately before making application for a raffle license and which have during that entire five-year period been engaged in carrying out their objects, or to a non-profit fund raising organization that the licensing authority determines is organized for the sole purpose of providing financial assistance to an identified individual or group or individuals suffering extreme financial hardship as the result of an illness, disability, accident or disaster, or to any law enforcement agencies and associations that represent law enforcement officials.
   (B)   (1)   Poker run licenses shall be issued only to bona fide religious, charitable, labor business, fraternal, educational, veterans', or other bona fide not-for-profit organizations that operate without profit to their members and which have been in existence continuously for a period of five years immediately before making application for a poker run license and which have during that entire five-year period been engaged in carrying out their objects. Licenses for poker runs shall be issued for the following purposes: (1) providing financial assistance to an identified individual or group of individuals suffering extreme financial hardship as the result of an illness, disability, accident, or disaster or (2) to maintain the financial stability of the organization.
      (2)   Waiver of five-year requirement. The five-year requirement under divisions (A) and (B)(1) of this section, may be waived for a bona fide religious, charitable, labor, business, fraternal, educational, or veterans' organization that applies for a license to a raffle or poker run if the organization is a local organization that is affiliated with and chartered by a national or state organization that meets the five-year requirement.
   (C)   No person, firm or corporation shall conduct raffles or chances or poker runs without having first obtained a license therefor pursuant to this chapter.
   (D)   All applications for any raffle or chance or poker run shall be made prior to the holding of the raffle or chance or poker run and shall be made to the Will County Executive. The following form shall be used.

§ 116.16 LICENSE FEE.
   (A)   Individual license. An individual license may be issued for a fee of $10 which shall be charged and payable at the time of application, for each license issued. Licenses issued pursuant to this chapter shall be valid for one raffle/poker run with a maximum aggregate prize value of $250,000 for the year. For raffles, the maximum price per chance shall not exceed $1,000 and the time for selling chances shall be limited to no more than 120 days.
   (B)   Annual licenses. An annual license may be issued for a fee of $25 which shall be charged and payable at the time of application, for each license issued. Licenses issued pursuant to this chapter shall be valid for up to 52 drawings for raffles or 52 poker runs per year with a maximum aggregate prize value of $2,000,000 for the year. For raffles, the maximum price per chance shall not exceed $1,000 and chances may be sold for 365 days.
***Licenses issued pursuant to this chapter may be suspended or revoked for any violation of this chapter.

§ 116.17 ISSUANCE.
   The county shall act within 30 days of the receipt of the application for a license. Issuance of the raffle license by the county authorizes sales of raffle chances only in the county.

§ 116.18 BOND REQUIRED.
   All operation and conduct of raffles shall be under the supervision of a single raffle manager designated by the organization. The manager shall give a fidelity bond in a sum of the aggregate retail value of the prizes set out on the application in favor of the organization, conditioned upon his or her honesty in the performance of his or her duties. Terms of the bond shall provide that notice shall be given in writing to the Will County Executive not less than 30 days prior to its cancellation. The Will County Board’s Executive Committee may waive this bond requirement by a majority vote of the members present. To be eligible for a bond waiver, the members of the licensed organization must first approve the bond waiver by an affirmative vote of the requisite number of members of the licensed organization or, if the licensed organization does not have members, of members of the governing board of the organization, to constitute an affirmative action of the licensed organization. As part of the bond waiver application, the licensed organization shall provide (1) an estimate of the cost to obtain the bond, and (2) proof of the licensed organization’s approval of the waiver, either by official letter, meeting minutes, or signed attestation on the waiver application. This section does not apply to poker runs.

CONDUCT OF RAFFLES
§ 116.30 RESTRICTIONS.
   The following restrictions apply to raffles in Will County.
   (A)   The entire net proceeds of any raffle or poker run must be exclusively devoted to the lawful purposes of the organization permitted to conduct that raffle or poker run.
   (B)   No person except a bona fide director, officer, employee, or member of the sponsoring organization may manage or participate in the management or operation of the raffle or poker run. Sponsoring organizations may contract with third parties who, acting at the direction of an under the supervision of the sponsoring organization, provide bona fide services to the sponsoring organization in connection with the operation of a raffle and may pay reasonable compensation for such services. Such services include the following: (a) advertising, marketing and promotion, (b) legal, (c) procurement of goods, prizes, wares and merchandise for the purpose of operating the raffle, (d) rent, if the premises upon which the raffle will be held is rented, (e) accounting, auditing and bookkeeping, (f) website hosting, (g) mailing and delivery, (h) banking and payment processing, and (i) other services relating to the operation of the raffle.
   (C)   If a licensee rents the premises on which to determine the winning chance or chances in a raffle, the rent may not be determined based upon the percentage of receipts or profits from the raffle.
   (D)   No person may receive any remuneration or profit for participating in the management or operation of the raffle.
   (E)   Winning chances may be determined only at those locations specified on the license.
   (F)   No person under the age of 18 may participate in the conducting of raffles or chances. A person under the age of 18 may be within the area where winning chances are being determined only when accompanied by his or her parent or guardian.
