§ 96.01 NO WAKE AREA.
   (A)   No person shall operate any motor powered watercraft in and upon the public waters of the Kankakee River in the county, specifically channels of water in the subdivision of Phelan Acres legally described as follows:
      Units 1-147, both inclusive, in Phelan Acres Condominium, as delineated on the Plat of Survey recorded September 8, 1981, as Document No. R81-2224 of the following described parcel of real estate: That part of the Southwest Quarter of Section 6, Township 33 North, Range 9 East of the Third Principal Meridian; lying North of the Northerly bank of the Kankakee River, which survey is Exhibit A to the Declaration of Condominium Ownership recorded in the office of the Recorder of Deeds of Will County, together with each of the undivided percentage interests in Common Elements as found in the Declaration, as amended from time to time all in the county; as to create a wake great enough to disturb a boat at rest, but under no circumstances shall a boat underway exceed five mph while in the posted “No Wake” area.
   (B)   The Department of Conservation or the County Sheriff’s Department is hereby authorized to post the area from May 1 through October 31 for the hours of 6:00 a.m. to 11:00 p.m., with buoys and/or appropriate signs paid for by the Phelan Acres Association which shall meet the specifications as prescribed by the United States Coast Guard or the State Department of Conservation, and to maintain the signs and/or buoys.
