Any person who operates any motor-powered watercraft in and upon the public waters of the Kankakee River in violation of the terms of this section, commits the offense of “Illegal Wake in Posted Area”, and upon conviction of the offense shall be guilty of a petty offense, provided, however that this section does not apply in the case of an emergency, or to patrol or rescue craft.
