(A) Generally. If an employee is required to work overtime (time in excess of eight hours per day or 40 hours per week), he or she shall be paid at the rate of time and one-half his or her regular rate for the overtime or be allowed to take time off at the rate of time and one-half for each hour worked. Overtime pay or time off shall be taken at the employee’s election. If time off is elected, it shall be taken at the discretion of the employer. Records are to be kept by the department head.
(B) Highway Department. An employee in the Highway Department shall work an eight-hour shift per day with a regular starting time and a regular quitting time. Any time before or after the regular shift shall be time and one-half his or her hourly rate. All hours worked in excess of eight hours per day or 40 hours per week shall be paid at the rate of time and one-half his or her hourly rate, or equal time off.
(1) Call out time shall be a minimum of two hours. Any employee working two hours or more shall be paid time and one-half his or her hourly rate for that period of time. Call out time is defined as all time prior to two hours before regular shift time, Saturdays, Sundays, holidays and any time called back to work after regular shift.
(2) Employees in the Highway Department shall report and check out for work at a regular reporting location, and if they are assigned to temporarily work in another part of the county, the employer shall furnish a vehicle or other transportation during the temporary employment, or pay $0.15 per mile.
(C) Sheriff’s Department. Employees in the Sheriff’s Department that must appear in court, inquests or pre-trial conferences on their off-time, shall receive a minimum of two hours pay; all time over this two hours shall be paid at the rate of time and one-half his or her hourly rate. Overtime shall only be paid after completion of a normal 40-hour week, and time spent in court, inquest time and pre- trial conference must be verified by the Sheriff.
(1) If requested by the Sheriff, the deputy may at his or her option, work eight additional hours on his or her day off, at straight time, to be coordinated with the shift commander and union steward on each shift.
(2) Holidays listed in § 36.020 shall be observed by the employees of the Sheriff’s Department. Holidays falling on Sunday shall be observed on Monday. Employees that are required to work on a calendar holiday shall be paid at the rate of double time his or her hourly rate.
(D) Nursing home. Employees in the nursing home who work in excess of eight hours per day shall be paid at the rate of time and one-half their hourly rate. All hours worked in excess of 40 hours per week shall be paid at the rate of time and one- half his or her hourly rate. Any part-time employee in the nursing home working 15 hours a week, or a minimum of 750 hours per year, shall be eligible to receive a pro-rated percentage of the vacation and sick leave benefits of a full-time employee.
