648.13   CURFEW.
   (a)   No child under the age of eighteen years shall be outside the confines of his homesite and congregate, wander, loiter or play upon the streets and other public places of the City, unsupervised or unenclosed lands or places of amusement and entertainment, between the hours of 10:00 p.m. and 6:00 a.m.
   (b)   No person having the control and custody of or being the parent or guardian of a minor shall knowingly permit such minor to be outside the confines of his homesite and to congregate, wander, loiter or play upon the streets and other public places of the City, unsupervised or unenclosed lands or places of amusement and entertainment, in violation of subsection (a) hereof, unless such person accompanies such minor in such public places or places of amusement and entertainment.
   (c)   The provisions of subsection (a) hereof shall not apply to minors accompanied by a parent, guardian or member of the minor's immediate family who is eighteen years of age or older.
   (d)   The provisions of subsections (a) and (b) hereof shall not apply to minors engaged in lawful employment requiring them to be upon the streets and other public places of the City, unsupervised or unenclosed lands or places of amusement and entertainment during such prohibited hours in the proper discharge of their duties while so employed, nor shall the provisions of such subsections apply to minors returning directly home from school activities held at any of the City schools under the supervision of the local school board and its employees.
   (e)   Any minor violating subsection (a) hereof shall be dealt with in accordance with Juvenile Court law and procedure.
   (f)   Whoever violates subsection (b) hereof is guilty of a misdemeanor of the fourth degree and shall be subject to the penalty provided in Section 698.02.
