1335.10   EXTENSIONS INTO SIDE YARDS.
No permit shall be issued for new construction or for an addition which extends into the side yard unless the applicant can show evidence of a recent survey by a registered surveyor and unless the property has permanent markers, that is, iron pins, concrete markers, etc. , at all corners of the lot. However, where, in the judgment of the Building Inspector, there will clearly exist at least twice the required distance from any lot line following construction for which the permit is issued, the Building Inspector may issue a building permit without such recent survey.
