(a) Falsifying Information. Any person who knowingly makes a false statement, representation, or certification in any application record, report, plan, or document filed or required to be maintained pursuant to this chapter; or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required or authorization under this chapter, shall be punished by the imposition of a fine of not more than one thousand dollars ($1,000) or by imprisonment of not more than six months, or both.
(b) Any industrial user or other person who willfully or negligently violates any other provision of this chapter or any orders or permits issued thereunder is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) per violation per day or imprisoned not more than six months or both.
(c) Recovery of Costs Incurred by the City. Any user violating any of the provisions of this chapter; discharges or causes a discharge producing a deposit or obstruction; or causes damage to or impairs the City's sewer collection system or POTW shall be liable to the City for any expense, loss, or damage caused by such a violation or discharge. The City shall bill the user for the costs incurred by the City for any cleaning, repair, or replacement work caused by the violation or discharge. Refusal to pay the assessed costs shall constitute a violation of this chapter.
(d) Any person who is found to have violated any order of the City or who has failed to comply with any provision of this chapter, regulations or rules of the City, or the orders of any court of competent jurisdiction, may be subjected to the imposition of civil penalty. Except as otherwise provided, any person, firm, or corporation violating any provision of this chapter shall be fined no less than one thousand dollars ($1,000). A separate offense shall be deemed committed each day during or on which the offense occurs or continues. After the second conviction, the City may discontinue the service of the City sewer system to the violator.
