901.03   COVENANT TO RESTORE EXCAVATION TO SAFE CONDITION; PERMIT FEE.
   If the proposed excavation is to be made in an unimproved public street or alley, the application for a permit shall contain a covenant that the trench or excavation shall be filled by the applicant in such a manner and with such material as will restore the street or alley to a condition safe and convenient for travel; that all of the work contemplated shall be subject to the inspection and approval of the City Manager or other officer designated by Council; and that if the applicant fails to restore the street or alley to a good condition, permitting the safe and convenient travel of the public thereon, he or she will pay to the City an amount equal to the cost of the restoration by the City. Before a permit may be issued for an excavation in an unimproved street or alley, the applicant shall deposit with the City Manager or other officer designated by Council twenty-five dollars ($25.00) to cover the cost of inspection of the excavation and restoration by the applicant.
