For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BOARD. Town Board of Commissioners of the Town of Wilkesboro.
GENERAL POLLUTION. Any type use of watershed as will endanger or threaten to endanger the health, safety, general welfare, persons and property of the users of water from the Town of Wilkesboro or may be hereafter users of the water.
NONIONIZING RADIATION. Radiation in any portion of the electromagnetic spectrum not defined as ionizing radiation, including but not limited to sources like laser, maser or microwave devices.
PERSON. Any individual, corporation, partnership, firm, association, trust, estate, public or private institution, group, agency, political subdivision of this state, any other state or political subdivision or agency thereof and any legal successor, representative, agent or agency of the foregoing.
POLLUTION. Any use of land which shall or may contaminate the watershed, whether it be ionization radiation, gamma rays and x-rays, alpha and beta particles, high speed electrons, protons, neutrons and other nuclear particles or any other contamination which would endanger or be likely to endanger or in any way contaminate the water system of the Town of Wilkesboro, thereby endangering the public health, safety, general welfare and protection of persons and property within the watershed of the Town of Wilkesboro and its source of water.
RADIATION MACHINE. Any device designated to produce or which produces radiation or nuclear particles when the associated control devices of the machine are operated or any other device machines or use which would pollute or tend to pollute water systems.
RADIOACTIVE MATERIAL. Any solid, liquid or gas which emits ionizing radiation spontaneously.
WATERSHED. All territory that drains into the Yadkin River west of Moravian Creek and the line running Northward from Moravian Creek and the line running Northward from Moravian Creek to the dividing line where the waters flow into the Yadkin River west of this line and extending westward with the dividing ridge running Southward constituting all of the flow and drainage into the Yadkin River to the dividing ridge between the tributaries of the Yadkin, then Eastward with the dividing ridge of the tributaries of the Yadkin River to a point east of Cub Creek and its tributaries and back to the point of beginning.
