§ 150.20 APPLICATIONS REQUIRED.
   (A)   Public housing shall be considered as where any individual person, firm or corporation or other entity shall undertake to acquire by purchase, lease or control of 3 or more houses or combination of houses with 2 or more families residing in any house, complex or combination of houses under the control of any 1 person, firm or corporation; for the purpose of leasing or renting same.
   (B)   Any person, firm, corporation or entity seeking to build or acquire through lease, purchase or otherwise, 3 or more units within the corporate jurisdiction of the Town of Wilkesboro, shall first make application to the Planning Board for approval of the project, purchase or ownership by management of any complex or combination of complex, and shall submit the application to the Planning Board for the Town of Wilkesboro for its action and subsequent to its action the request shall go to the Town Board for the action of the Town Board to approve or reject.
   (C)   Prior to the petition being passed on by the Town Board, it shall be required that the town will require a public hearing and notice thereof shall be published in the local newspaper, once a week for 4 consecutive weeks prior to the hearing, and after the public hearing the Town Board by majority vote shall approve or reject the application.
   (D)   The expense of the notice and hearing shall be at the expense of the applicant which will be required to be paid in advance to the Town Clerk.
   (E)   No permit for water, sewer or any other permits as required by the Building Code of the Town of Wilkesboro shall be issued until the final approval of the Board of Commissioners.
   (F)   This chapter shall not affect any previously issued permits, prior to the adoption of the chapter. If any portion of this chapter or clause herein is declared void, it shall not affect any other portions.
