It shall be the duty of any person owning or having charge of a lot or tract of land within the town, across, over or upon which there is a ditch or other natural or artificial channel, to keep the ditch or channel cleaned out so as to permit at all times a free flow of water that collects therein. Upon notice from the Town Manager, Chief of Police or Board of Health that any ditch or channel, either natural or artificial, is a menace to the health of the people of the town, it shall be the duty of the owner or person in charge of the lot or tract to clean out the ditch or channel within 5 days. Any owner or person in charge who shall fail to comply with that notice shall, upon conviction thereof, pay a penalty for each day or part of day that the ditch or channel remains uncleaned.
