(A) Any police officer of the town, upon finding any vehicle parked in violation of any of the provisions of this chapter, if the owner or operator is not present, may have the vehicle moved from the street and placed in storage at the expense of the owner or operator of the vehicle.

(B) Any person parking on property of another without his or her permission shall be considered a trespasser and the owner of the premises may have the vehicle towed away and the cost thereof shall be a lien on the vehicle.

(C) It shall be the duty of any officer of the Town of Wilkesboro who has issued a parking ticket or unlawful parking of a vehicle in a no parking zone or for illegal parking, who has not paid the ticket in a specified time (30 days) in accordance with the orders of the ordinances to issue a warrant charging a violation of the parking chapter; and have the person guilty of violations cited to court. This for failure to abide by the ordinances of the Town of Wilkesboro.

(D) (1) Any police officer of the town, upon finding any vehicle parked in violation of this section shall attach thereto, or give to the owner or operator thereof, a citation stating the nature of the offense, and the owner or operator of the vehicle shall within 48 hours after receipt of violation take the citation to Police Headquarters in the Town of Wilkesboro and pay to the Chief of Police or his or her designated assistant a penalty as referenced in the town’s schedule of fees for each offense. Upon failure of the owner or operator of any vehicle parked in violation of this section to take the citation ticket to the Police Headquarters in the Town of Wilkesboro and pay the penalty as aforesaid a civil suit shall be instituted by the town against the owner or operator for the purpose of enforcing and collecting the civil penalties imposed by this section. The civil penalty as reference in the town’s schedule of fees shall not be applicable to parking violations involving a designated parking space for handicapped persons. In accordance with G.S. § 20-37.6, a parking violation which occurs in a designated parking space for handicapped persons shall carry a penalty as reference in the town’s schedule of fees and the amount of the penalty shall be plainly set forth on the sign designating the parking space for handicapped persons. In accordance with G.S. § 20-37.6(f)(4) parking violations which occur in designated parking spaces for handicapped persons shall be enforced by the town, whether on public or private property, in the same manner as is used to enforce other parking laws and ordinances by the Town of Wilkesboro.
(2) Any police officer of the town, upon finding any vehicle parked in violation of G.S. § 20-37.6 shall attach thereto, or give to the owner or operator thereof a citation stating the nature of the offense, and the owner or operator of the vehicle shall within 48 hours after receipt of the violation take the citation to Police Headquarters in the Town of Wilkesboro and pay to the Chief of Police or his or her designated assistant the penalty as authorized by this section. Upon failure of the owner or operator of any vehicle parked in violation of G.S. § 20-37.6 to take the citation ticket to the Police Headquarters in the Town of Wilkesboro and pay the penalty as aforesaid a civil suit shall be instituted by the town against the owner or operator for the purposes of enforcing and collecting the civil penalties imposed by G.S. § 20-37.6 and by this section.
