§ 111.99 PENALTY.

   (A)   Any person who shall violate any of the provisions of §§ 111.01 through 111.17 of this chapter shall, upon conviction thereof, for the first offense, be punished by a fine of not less than $25 nor more than $100, or by imprisonment for not more than one month, or both; and for the second and subsequent offenses thereof, be punished by a fine of not less than $50 nor more than $200, or by imprisonment for not more than 6 months, or both, and each day's violation shall constitute and be considered a separate offense. Violation of §§ 111.01 through 111.17 is designated a misdemeanor.

   (B)   Any person, firm, or corporation convicted of violating § 111.08 shall be guilty of a misdemeanor and shall be fined not less than $25 and no more than $500 in the discretion of the Campbell County District Court. (Ord. 90-0604, passed 7-2-90)

   (C)   Performing nude or nearly nude activities as set forth in § 111.16 or permitting such activities as set forth in § 111.17, is a violation and punishment shall be fixed as set forth in the Kentucky Revised Statutes.

      (1) The second violation of §§ 111.16 and 111.17 within a 12-month period shall constitute a Class B Misdemeanor with punishment as set forth in the Kentucky Revised Statutes.

      (2) Three or more violations of §§ 111.16 and 111.17 within a 12-month period shall constitute a Class A Misdemeanor with punishment as set forth in the Kentucky Revised Statutes. (Ord. 82-1201, passed 1-3-83)
