94.99 PENALTIES.
   (A)   Any person violating any of the provisions of § 94.11 shall be subject to a minimum penalty of two hundred fifty ($250.00) dollars.
   (B)   Waiver provision: The penalty for noncompliance with § 94.11 may be waived if the dwelling or dwelling unit is brought into compliance with § 94.11 within thirty (30) days of the original violation. The property owner must request an inspection from the Fire Prevention Bureau to verify compliance and have this waiver provision applied.
   (C)   Any person who continues in violation of § 94.11 shall be guilty of a misdemeanor and subject to a fine of $1,000.00 or six (6) months in jail.

   (D)   Any person who violates § 94.26 shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class A Misdemeanor and subject to a fine of up to five hundred dollars ($500) or imprisonment of up to one (1) year or both by such fine and imprisonment as is otherwise provided by law for the offense. Each day the violation occurs, exists, or continues shall be deemed to be a separate offense.
   (E)   In addition to the penalties provided in § 94.99(D), any person violating any provisions of this section shall be civilly liable to the appropriate city and/or county governments for any expense, loss, or damage to the governments or agencies thereof caused by reason of the violation, including but not limited to, any response, administrative and legal expenses.
