(A) Whenever an enforcement officer shall determine that a structure is in noncompliance with the provisions of § 154.41 of this subchapter, the enforcement officer shall issue a written notice to the owner of the property with regard to the deficiencies of the structure. Such notice shall set forth the following information:
(1) A specification of the identity of the structure, and a description of the real property upon which the structure is located;
(2) A specification of the deficiencies of the structure, which renders the structure to be in noncompliance with § 154.41 of this subchapter;
(3) A demand that the noted deficiencies be remedies within a reasonable period of time, as determined by the enforcement officer in his or her reasonable discretion, but in no event, not less than 30 days following the issuance of the notice;
(4) A notification to the owner that in the event the owner fails to cure and remedy the deficiencies within the time period as determined by the enforcement officer, the city will have the structure demolished at the owner’s cost; and
(5) A notification to the owner that the owner has the right to appeal the determination made by the enforcement officer to the City Council by making a written demand for a hearing before the City Council, and serving such written demand upon the Clerk of the city within 30 days following the owner’s receipt of the written notice. The notification shall further provide that in the event that the owner fails to make such written demand upon the City Council, the owner shall have no further right to appeal the action taken by the enforcement officer.
(B) The enforcement officer shall cause the written notice to be sent by certified mail, return receipt requested, to the last known address of the owner of the property, as such address appears on the current tax assessment roll. In the event an owner is a resident of the city, the enforcement officer shall have the authority to personally serve such written notice upon the owner in lieu of mailing such written notice. In the event of personal service upon any owner, the enforcement officer shall make an affidavit evidencing such personal service.
