331.43 TESTING VEHICLES PROHIBITED.
   (a)   No person shall operate or cause to be operated any motor vehicle upon any street for the purpose of testing the vehicle. "Testing", within the meaning of this section is hereby defined to be running or driving such vehicle for the purpose of ascertaining its fitness for service before its sale by or for the manufacturer or other owners or proprietors of the same.

   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
