963.021 INDIGENT CREMATION.
   (a)   An indigent person means a person or persons whose income is at the current poverty threshold established by the United States Office of Management and Budget (§120.51(B), Ohio Revised Code). The determination of indigency shall be in the manner provided by Section 120.05 of the Ohio Revised Code.
   (b)   When the body of a dead person is found in the City of Wickliffe and such person was not an inmate of a correctional, benevolent or charitable institution of this state, and the body is not claimed by any person for private interment or cremation at the person’s own expense, or delivered for the purpose of medical or surgical study or dissection in accordance with Section 1713.34 of the Ohio Revised Code, it shall be disposed of as follows:
      (1)   If the decedent was a legal resident of the City of Wickliffe and the decedent is indigent as defined by Section 120.51(B), Ohio Revised Code, the proper officers of the City in which the decedent’s body was found shall cause the body to be cremated at the expense of the City of Wickliffe. Such officers shall cause the decedent’s cremated remains to be scattered in the Wickliffe Cemetery scattering garden. The name of the indigent deceased shall become part of the permanent records of the Wickliffe Cemetery; a memorializing plaque in the scattering garden shall bear the inscription of the name of the deceased and their date of birth, if known, and date of death.
   (c)   The City accepts its duty to cremate an indigent deceased at its expense under this section when the body is claimed as an indigent person as defined aforesaid.
