1158.03 DEFINITIONS.
   (a)    The following definitions shall apply in the interpretation and enforcement of the Residential Building Maintenance Code.
      (1)    "Accessory building" means a secondary or appurtenant building, the use of which is incidental or accessory to that of the main building, and which is attached thereto or located on the same premises.
      (2)    "Code" means the Residential Maintenance Building Code, being Title Five, Chapter 1158 of Part Eleven of the Codified Ordinances of the City of Wickliffe, Ohio.
      (3)    "Commissioner of Building" when used herein, shall be construed as though followed by the words "or his authorized agent or representative".
      (4)    "Dwelling structure" means a building or structure or that part of a building or structure used, designed or intended to be used, all or in part, for residential purposes.
      (5)    "Dwelling" means a building intended or designed to be occupied by not more than two families living separately and independent of each other.
      (6)    "Garbage" means the animal, vegetable or mineral waste from the handling, preparation, cooking and consumption of food.
      (7)    "Multi-family dwelling" means a building consisting of three or more dwelling units with varying arrangements of entrance and party walls, including apartment houses and row houses.
         A.    "Row house" means a multi-family dwelling comprised of dwelling units attached in a row or group, having party walls and each unit having at least one separate outside entrance.
         B.    "Apartment building" means a multi-family dwelling comprised of three or more dwelling units (apartments) arranged side by side and/or one above the other and each having a separate entrance or entrances connected to a common outside entrance or entrances.
      (8)    "Occupant" means a person over one year of age, living, sleeping, cooking or eating and having actual possession of a dwelling structure.
      (9)    "Operator" means a person who has charge, care or control of a dwelling structure.
      (10)    "Owner" means the owner or owners of the premises including the holder of title thereto subject to contract of purchase or vendee in possession, a mortgagee or receiver in possession, a lessee or joint lessees of the whole thereof or any agent or any other person, firm, corporation or fiduciary directly in control of the premises.
      (11)    "Premises" describes a lot, parcel or plot of land, including the buildings or structures thereon
      (12)    "Rubbish" means combustible waste materials, except garbage. The term includes the residue from the burning of wood, coal, coke and other combustible material, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery and dust.
