(a) For new single, double, or triplex dwellings, fees shall be determined by the square foot aggregate floor area in the following manner: Two hundred fifty dollars ($250.00) plus four dollars ($4.00) for each 100 square feet or fraction thereof.
(b) The term "aggregate floor area" as used in this section means the total square foot area of the basement, habitable rooms, enclosed porches, and unfinished attics or third floor which are capable of being or can be finished for habitable purposes, of new single, double, or triplex dwellings. However, if any law or ordinance prohibits the use of an attic or third floor for habitation, then the square foot area thereof shall not be included for the purpose of determining the fee.
