(a) No person, firm or corporation shall sell, offer or expose for sale, give or furnish any synthetic detergent or detergent containing more than one-half percent (0. 5%) of phosphorus by weight expressed as elemental phosphorus, after September 15, 1981.
(b) No person, firm or corporation shall sell, offer or expose for sale, give or furnish any synthetic detergent or detergent which requires a recommended use level of the synthetic detergent or detergent which contains more than 0.16 grams of phosphorus by weight expressed as elemental phosphorus, from and after September 15, 1981.
(c) This section does not apply to:
(1) A cleanser, rinsing aid or sanitizing agent intended primarily for use in automatic or machine dishwasher;
(2) An industrial and commercial conversion coating agent, corrosion remover, paint remover, rust inhibitor, metal brightener, etchant or other surface conditioner;
(3) A solvent cleaner or other similar product not normally used with water;
(4) A disinfectant or sanitizer used in institutions, hospitals or health care facilities;
(5) A compound or product used in the manufacture or processing of foods or food products, including those used in dairy, beverage, egg, fish, poultry, meat, fruit or vegetable processing facilities;
(6) A product intended primarily for personal use, including but not limited to bathing soaps, dentifrices, shampoos, cleansing creams, toothpastes or other products for the care of the human body;
(7) A product subject to registration or control under federal or state law governing foods, drugs, cosmetics, insecticides, fungicides or rodenticides;
(8) A product normally not used with water, such as a cleanser for windows, ovens or other hard surfaces;
(9) A water softening chemical, antiscale chemical or corrosion inhibitor intended for use in circulatory systems, such as boilers, air conditioners, cooling towers or hot water heating systems.
(d) The concentration of phosphorus by weight, expressed as elemental phosphorus in any synthetic detergent or detergent shall be determined by the current applicable method prescribed by the American Society for Testing and Materials.
