§ 91.03 FILMING GUIDELINES.
   (A)   Notification of affected businesses and residents. All local businesses and/or residents which will be burdened or affected by the activity must be contacted immediately after approval of the film permit or at least seven days before filming or related activities are scheduled to proceed, whichever is longer. The production company must furnish the city with the list of residents and businesses that will be directly burdened by the project, i.e., loss of parking, delayed vehicular and pedestrian traffic, inconvenient hours and the like.
   (B)   Traffic-control, street closures and police/fire services. Approval must be obtained from the city and, if applicable, the North Carolina Department of Transportation when film activity will obstruct the flow of vehicular traffic or call for a street closing.
      (1)   Traffic control shall be handled by off-duty city police officers who shall be paid by the production company. Unless specifically described and approved in the film permit, intermittent traffic holding patterns should last no longer than three minutes.
      (2)   In all cases when combustible materials, fire, explosives or other special effects of this nature are to be used, the Fire Official shall be notified and given all plans and procedures. If representatives of the Fire Department are needed at the site or for any reason concerning the project, the individuals shall also be off-duty and shall be paid by the production company.
      (3)   All arrangements concerning off-duty police and fire services, including the leasing of any city vehicles, shall be facilitated through the City Manager.
   (C)   Building. All construction which will take place in the city and which is related to the production shall be inspected by the City Building Inspector. The Inspector will
conduct all inspections on city time.
   (D)   Removal of vegetation. Removal, cutting, trimming or the overall disturbance of vegetation in the public right-of-way is prohibited unless specifically approved by permit.
   (E)   Fees. There is a $100 non-refundable fee for all film permits for each day of filming. The permit fee shall be paid upon issuance of the permit. If filming days are extended, the applicant agrees to pay for each additional day of filming. In addition to the permit fee, there are charges associated with the use of certain city services, vehicles and personnel.
   (F)   Violations. Any violation of the conditions set forth in the film permit, any local ordinance or the requirements of the City Building Inspector or City Engineer may result in the cancellation of the permit by the city. Should the film permit be cancelled, the company shall then be required to cease all filming activities and remove all equipment and personnel from the premises. Further violations of any local ordinance shall constitute a misdemeanor, as described in § 10.99 of this code of ordinances.
   (G)   Insurance. In the event city property will be used during the filming, the city will require adequate insurance coverage for claims arising from bodily injury and/or property damage which may arise directly or indirectly from the applicant’s filming activity.
