§ 61.01 PROHIBITED PARK ACTIVITIES.
   (A)   General prohibitions.
      (1)   It shall be unlawful for any person in any park, playground, ball field or surface courts, or any other recreation facility or the parking facilities thereof, owned or controlled by the city to do the following:
         (a)   Willfully mark, deface, disfigure, injure, tamper with or displace or remove any structure, equipment, facilities or other property, either real or personal;
         (b)   Damage, cut, carve, transplant or remove any tree or plant, or injure the bark or pick the flowers or seeds of any tree or plant, or dig or otherwise disturb grass areas or in any other way injure or impair the natural beauty or usefulness of any area;
         (c)   Bring in, dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, wastes, garbage or refuse, or other trash;
         (d)   Fail to obey all police officers and Parks and Recreation Department employees, the persons being hereby authorized and instructed to direct proper park behavior;
         (e)   Drive any vehicle on any area except the paved park roads or parking areas or any other areas that may be specifically designated by the Director of Parks and Recreation;
         (f)   Park a vehicle in other than an established or designated parking area;
         (g)   Hold meetings, reunions or organized picnics without prior notice to the Parks and Recreation Department;
         (h)   Leave a picnic area before the fire is completely extinguished and before all trash in the nature of boxes, papers, cans, bottles, garbage and other refuse is placed in the receptacles provided. If no trash receptacles are available, then refuse and trash shall be carried away from the park area by the user to be properly dispensed of elsewhere;
         (i)   Bring or have in his or her possession, alcohol or any type of explosive that may discharge or burn;
         (j)   Build or attempt to build a fire except in those areas and under the regulations that may be designated for the purpose by the Director of Parks and Recreation. No person shall drop, throw or otherwise scatter lighted matches, burning cigarettes or cigars, or flammable material within any park area or on any road or street abutting or contiguous thereto;
         (k)   Engage in loud, boisterous, threatening, abusive, insulting or indecent language, or engage in any disorderly conduct or behavior tending to a breach of the public peace;
         (l)   Disturb or interfere unreasonably with any person or party occupying any area or participating in any authorized activity; and
         (m)   Enter, use or remain within the park in violation of the hours promulgated and posted by the Director of Parks and Recreation establishing the hours for the park to be open and to be used by the general public.
      (2)   Flagrant misuse of parks and recreational facilities will result in forfeit of future reservation privileges. The Director of Parks and Recreation has the authority and responsibility to establish and enforce any rules and regulations governing the use and maintenance of parks and recreational facilities.
      (3)   Any section or part of any park or recreation area or facility may be declared closed to the public by the Director of Parks and Recreation at any time and for any interval of time, either temporarily or at regular and stated intervals (daily or otherwise) and to certain uses.
      (4)   The Director of Parks and Recreation and any authorized department employee shall have the authority to eject from any recreation facility, any person acting in violation of this section, or in violation of rules and regulations enacted pursuant to this section or any ordinance adopted by the City Council.
   (B)   Prohibitions for Whiteville City Park.
      (1)   It shall be unlawful for any person or persons to enter upon the premises of any city park between the hours of dusk to dawn, unless special permission has been obtained from the City’s Parks and Recreation Director or unless a person or persons are attending an authorized, organized event in the parks. It is unlawful for any person or persons to enter upon the premises of the city’s recreational center when it is closed, unless special permission has been obtained from the City’s Parks and Recreation Director or unless a person or persons are attending an authorized, organized event inside the building.
      (2)   It shall be unlawful for any person to have in his or her possession while on the premises of the Whiteville City Park or to carry, use or possess, open or unopened, any alcoholic beverages or controlled substances.
   (C)   Firearms. Except as provided in Chapter 43, it shall be unlawful for any person to possess and display a firearm on or within East City Park, West City Park, Doc Currie Park, Leder Park, Felix Smith Park, the Recreation Center and each building or portion of a building owned, leased as lessee, operated, occupied or controlled by the city, as well as the appurtenant premises to the buildings.
