(A) Failure to cease smoking or the use of tobacco/e-cigarette products in accordance with § 32.03 constitutes an infraction punishable by a fine of not more than $50.
(B) A citation for violating § 32.03 may be issued by a Code Enforcement Officer of the city, such as a Police Officer, Fire Chief, Code Enforcement Officer, or Emergency Services Director.
(C) An infraction under this section has no consequence other than payment of a penally, and no court costs may be assessed.
(D) In addition to any penalty provided for in this section, employees who violate § 32.03 shall be subject to disciplinary action consistent with the city's personnel policy.
