§ 73.35  ENGINE BRAKES.
   (A)   Generally. It is the purpose and goal of the municipality to provide a quality place to reside and do business. Inasmuch, the peace and tranquility of this municipality is paramount to promoting the aforesaid goals. Wherefore, the following related noises are declared a nuisance and are in violation of law.
   (B)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      ENGINE BRAKES (COMMONLY REFERRED TO BY BRAND NAMES SUCH AS JACOBS BRAKE, JAKE BRAKE OR DYNATARD BRAKE). An engine retarder or dynamic braking device used primarily on large trucks for the conversion of the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.
      ENGINE BRAKING DEVICE NOISE. Any noise created from the operation of any motor vehicle with an engine brake engaged that can be manually turned on and shut off from within the vehicle.
   (C)   Exceptions. Any emergency vehicle operated in the course of public safety. Any vehicle that has no other means of braking.
