§ 9.6.160 PROCEDURES.
   Unless exempted by M.C.A. § 76-3-203, all condominium developments are subdivisions subject to the terms of the MSPA as follows:
   (A)   Review where land will not be divided. If no division of land will be created by a condominium subdivision, the subdivision must be reviewed under the procedures contained in § 9.6.128 , Subdivisions Created by Rent or Lease, with the following exception: final approval will not be given until the subdivider has either installed all required improvements, or has entered into a subdivision improvements agreement pursuant to § 9.6.28 , Public Improvements Agreement.
   (B)   Condominium subdivisions involving land divisions. If a proposed condominium development will involve a division of land, the subdivision must be reviewed under the procedures contained in sections:
      (1)   Section 9.6.60, Review and Approval Procedures for Major Subdivisions; and
      (2)   Section 9.6.22, applicable sections for Final Plats.
